BCM and CPCNH Help Preserve Fair Market Competition in New Hampshire’s Energy Sector


BCM Environmental & Land Law is proud to serve as regulatory counsel for the Community Power Coalition of New Hampshire in making real change. In that role, two weeks ago, with BCM’s representation and CPCNH’s talent and deep knowledge base, the N.H. Public Utilities Commission issued an order protecting competition and customer choice. In a May 20 decision, the PUC rejected a proposal by Unitil to recover default energy supply costs by adding them to its Stranded Cost Charge. Had these proposals been implemented, non-participating customers would have been forced to pay fixed charges regardless of their chosen supplier – undermining customer choice and distorting the market. Instead, the PUC upheld a long-standing policy that utility supply costs must be recovered through default service rates, and not distribution charges. The decision will help ensure New Hampshire’s energy market stays fair, transparent, and competitive – supporting the rights of communities and individuals to choose how they source their electricity.
